2.     Offer Period: This offer runs periodically, and customers will be notified when on the website or other direct communication channels such as email.​

3.      How to qualify: The "Try Me" offer entitles you to receive a 1 ml or 1.5 ml sample of selected products when you purchase the corresponding full-size equivalent. While supplies last.​

4. Brand and product inclusions:

6.     Limitations : Returns of products purchased during the promotional campaign are accepted within 14 days of receiving the order. The returned fragrance must be intact and in its original packaging, while the added sample is non-returnable​

7.     Returns: For more information on returning products, please see our Returns Policy. The Returns Policy is enforced by reference, which means it is incorporated into these Terms and Conditions.​

8.     All ARC Store products, including those sold online, may not be purchased for resale. If we suspect that such goods are being purchased for resale, we have the right to cancel or stop your order immediately.​

10.   Use of participant and customer information: You acknowledge and expressly consent that we may process your personal information for purposes of maintaining your membership to ARC Store. ​

11.   Access of information: ​

  1. (a) You have the right to access your personal information held by us. We will grant you such access during office hours within a reasonable time after receiving such a written request for access. ​
  2. (b) Your personal information will only be kept for as long as it is required to be retained by law. ​
  3. (c) You have the right to request the correction, destruction or deletion of personal information held by ARC, or to object to the processing of personal information, in which event you will no longer be able to be a participant in the offer. ​
  4. We will only do this in the event that you have consented to marketing if you are a Clubcard member. ​
  5. If you have given us permission to contact you for marketing purposes, you agree that we may send you relevant marketing information and promotional offers from Arc Store. This applies,  ​
  6. but is not limited to, marketing goods and services to you across all marketing channels, including online /e-mail / mail / SMS / MMS / telephonic / social media. We will always give you an option to opt out of future marketing when we market to you.​
  7. Please ensure that your personal and contact details are correct and up to date to enable us to offer you Arc Store offers and promotions. If your contact details change at any time, please update your details online or via our Customer Service on 087 330 4946 (Monday to Friday 08:30 – 16:30). ​
  8. We will not be held responsible if you do not receive your personalised offers in the event that your personal details have changed, and you have not notified us. ​

 

ARC Returns Policy

1. Overview

1.1. This Returns Policy regulates the conditions and circumstances in which Products purchased by consumers (“You/Your”) on-line or in-store will be accepted by Mistragystix (Pty) Ltd trading as  ARC Store  (“ARC”) for return and refund. ​

1.2. You are not entitled to any refund, repair or replacement save to the extent that it is expressly provided for in terms of this Returns Policy.​

1.3. Please note that You may not return a: ​

1.3.1. gift voucher in exchange for the value of the gift voucher and You may only use a gift voucher to purchase Products either in-store or on-line and no amounts standing to the credit of Your on-line account, will be paid out in cash.​

2. Right to Return Non-defective Products

2.1. If You are unsatisfied with Your purchase after receiving the Product, which is not a sale, clearance and/or promotional item, You may return it to ARC within 14 days from date of purchase in the case of an in-store purchase or date of delivery in the case of an on-line purchase, without reason or penalty, in order to obtain a refund of the full purchase price, provided that:​

2.1.1.    the Products are in their original purchased condition and packaging without the seal (where applicable) having been broken in any way;​

2.1.2.    for hygiene reasons no cosmetics or fragrances may be returned and Products that have been used, altered, repaired, incorporated or added to, may not be returned;​

2.1.3.    if applicable, the price (swing) ticket and labels are attached to the Products or their packaging;​

2.1.4.    the original till slip in the case of an in-store purchase accompanies the return and the ARC on-line order number is provided, in respect of the return of an on-line purchase.​

2.2.You may return a sale, clearance and/or promotional Product to ARC after the purchase thereof, within 7 days from date of purchase in the case of an in-store purchase or date of delivery in the case of an on-line purchase, without reason or penalty, in order to obtain a refund of the full purchase price, provided that the provisions of clauses 2.1.1 to 2.1.4 have been complied with, failing which the return will not be accepted and no refund will be given.​

2.3. You may not return an item which has been personalised for you or customised to your specification unless defective.​

3. Right to Return Defective Products

3.1. You can return defective Products, for a replacement, repair or refund, within 6 months of the date of purchase in the case of an in-store purchase or date of delivery for on-line purchases, provided that You provide Your proof of purchase.​

3.2. Products will not be regarded as defective where the fault in the Products results from normal wear and tear, negligence or damage arising from misuse and/or improper or inadequate care of the Products and/or where the items have been altered and/or dealt with or used contrary to the manufacturer’s instructions.​

4. Refunds

4.1. Where applicable, ARC will refund You the purchase price, which You paid for the returned Products, as follows:​

4.1.1.    Cash purchases will, at Your election, be refunded to You by means of electronic funds transfer into Your bank account or by means of an ARC gift voucher;​

4.1.2.    purchases made on credit will be refunded to Your account held with the applicable credit provider;​

4.1.3.    credit and debit card purchases will be refunded to the credit card used to make the initial purchase; and​

4.1.4.    gift voucher purchases will be refunded to You by means of electronic funds transfer into Your bank account in the case of an in-store purchase or, at Your election, in respect of an on-line purchase, either by means of electronic funds transfer into Your bank account or by crediting Your on-line ARC account.​

5. Procedure to be followed

5.1. If you purchased the Product, which you want to return in terms of these terms and conditions:​

5.1.1.    in an ARC store – please take the returned Product together with your proof of purchase to any ARC store;​

5.1.2. For credit/debit card refunds; You need to produce the debit/credit card used to make the initial purchase as per your proof of purchase;​
